Terms of Service

The agreement governing your access to and use of pantrywonderbnch.living, operated by Azulejo Media Publishing Lda.

1. Acceptance of these Terms

These Terms of Service ("Terms") form a legally binding agreement between you ("you", "the user") and Azulejo Media Publishing Lda., Company Number 517884302, registered at Rua da Rosa 184, 2.º Esquerdo, 1200-387 Lisboa, Portugal ("we", "us", "the Publisher"). By accessing, browsing or otherwise using pantrywonderbnch.living ("the Site"), you confirm that you have read, understood and agreed to be bound by these Terms and by our Privacy Policy and Cookie Policy. If you do not agree, you must stop using the Site immediately.

2. Nature of the service

The Site is an independent editorial publication about luxury hotels and travel in Lisbon, Portugal. It provides descriptive articles, property profiles, orientation guides and opinion. We are not a travel agency, tour operator, booking platform, reservation intermediary or agent of any hotel. We do not take bookings, hold inventory, accept deposits, issue confirmations or handle payments. Any reservation you make is a direct contract between you and the relevant hotel or booking provider, governed entirely by their terms.

3. Accuracy of information and no warranty

We research carefully and correct promptly, but hotel details change constantly: rooms are refurbished, restaurants close and reopen under new concepts, facilities are withdrawn, and prices move seasonally. All content on the Site is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, completeness, currency or non-infringement.

You must verify all material details — room categories, accessibility, opening hours, dining availability, pricing and cancellation conditions — directly with the property before making travel commitments. Where we publish a property's official website address, that source takes precedence over our description in the event of any conflict.

4. User obligations and acceptable use

You agree that you will:

We reserve the right to investigate suspected breaches and to report unlawful activity to the competent authorities.

5. Intellectual property rights

All editorial text, headlines, layout, structure, graphic design, illustration, source code, stylesheets, the "pantrywonderbnch.living" name and the azulejo tile mark are the property of Azulejo Media Publishing Lda. or its licensors, and are protected by Portuguese and international copyright, database and trademark law.

You may view pages on screen, print single copies for personal non-commercial reference, and quote short extracts of up to seventy-five words in reviews, academic work or commentary, provided the quotation is accurate, is attributed to pantrywonderbnch.living, and is accompanied by a working hyperlink to the source page. You may not republish, redistribute, syndicate, translate, adapt, sell, sub-licence or incorporate our content into any dataset, training corpus or derivative product without prior written consent.

Photographic material is licensed from third-party providers or supplied by properties. Photography licences do not transfer to you and images may not be extracted or reused.

Hotel names, logos and marks referenced on the Site remain the property of their respective owners. Their use here is descriptive and editorial, and does not imply endorsement, sponsorship or affiliation.

6. User submissions

If you send us a correction, tip, suggestion or other material, you grant Azulejo Media Publishing Lda. a worldwide, royalty-free, perpetual, irrevocable, non-exclusive licence to use, reproduce, edit, adapt and publish that material in connection with the Site and its promotion, in any medium. You confirm that you own or control the necessary rights and that the material does not infringe any third-party right or breach any confidentiality obligation. We are under no obligation to publish, attribute or respond to submissions, and no compensation is payable.

7. Third-party links and embedded content

The Site contains hyperlinks to hotel websites, cultural institutions, transport operators and other third-party resources, and embeds third-party content including maps and images. These are provided for convenience and further reading. We do not control, endorse, monitor or accept responsibility for the availability, accuracy, legality, security or content of external sites, nor for any transaction you enter into with them. Accessing third-party content is entirely at your own risk and subject to that party's own terms and privacy practices.

8. Editorial independence and disclosure

Our editorial decisions are made independently. Hotels cannot buy inclusion, position or favourable coverage. Where a stay, meal, transfer or experience has been provided at reduced or no cost, that fact is disclosed prominently on the relevant page. Any sponsored or affiliate content, should it appear in future, will be clearly labelled as such before the content begins.

9. Limitation of liability

To the fullest extent permitted by applicable law:

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded. If you are a consumer, these Terms do not affect your mandatory statutory rights under Portuguese or EU consumer protection law.

10. Indemnity

You agree to indemnify, defend and hold harmless Azulejo Media Publishing Lda., its directors, employees and contributors against any claims, liabilities, damages, losses and reasonable legal costs arising from your breach of these Terms, your misuse of the Site, or your infringement of any third-party right.

11. Availability, changes and termination

We aim to keep the Site available continuously but give no guarantee of uninterrupted access. We may suspend, withdraw, restrict or modify all or part of the Site for maintenance, development, security or business reasons without notice or liability. We may also revise, correct, archive or delete any content at any time.

We may terminate or restrict your access to the Site immediately and without notice if we reasonably believe you have breached these Terms. You may terminate this agreement at any time by ceasing to use the Site. Sections concerning intellectual property, user submissions, limitation of liability, indemnity and governing law survive termination.

12. Amendments to these Terms

We may amend these Terms from time to time to reflect changes in law, regulation or our practices. The effective date at the top of this page indicates the current version. Continued use of the Site after an amendment constitutes acceptance of the revised Terms. Material changes will be signalled by a homepage notice for at least thirty days.

13. Governing law and jurisdiction

These Terms, their subject matter and their formation are governed by the laws of the Portuguese Republic, without regard to conflict-of-law principles. The courts of the District of Lisbon, Portugal, shall have exclusive jurisdiction over any dispute, save that where you are a consumer resident in another EU Member State you retain the right to bring proceedings in the courts of your country of residence, and to rely on the mandatory consumer protection provisions of that country.

14. Dispute resolution

Before commencing formal proceedings, we ask that you contact us at [email protected] so that we can attempt to resolve the matter informally. We will acknowledge within five working days and aim to provide a substantive response within thirty days.

Consumers resident in the European Union may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr, or refer the matter to a recognised Portuguese alternative dispute resolution entity (Centro de Arbitragem de Conflitos de Consumo de Lisboa).

15. General provisions

Severability: if any provision is held invalid or unenforceable, the remaining provisions continue in full force. No waiver: our failure to enforce a right does not waive it. Entire agreement: these Terms, together with the Privacy Policy and Cookie Policy, constitute the entire agreement between you and us regarding the Site. Assignment: you may not assign your rights under these Terms; we may assign ours in connection with a merger, acquisition or sale of assets. Force majeure: we are not liable for failure to perform due to events beyond our reasonable control. Language: these Terms are published in English; any translation is provided for convenience and the English version prevails.
